Chapter 1 General Provisions


Article 1 [Purpose)

These terms and conditions are the terms and conditions of use of services provided by the Korea Tire Industry Association's website (hereinafter referred to as the "Association Homepage") operated by the Korea Tire Industry Association (hereinafter referred to as "the Association"), the rights and obligations of the Association and users The purpose is to define responsibilities and other necessary matters.

Article 2 (Definition)

The definitions of terms used in these terms and conditions are as follows.
1. “Association homepage” refers to the homepage (http://www.kotma.or.kr) operated by the association.
2. “User” refers to a paid member who has paid an annual membership fee, logs in to the association's website, and receives the services provided by the association in accordance with these terms and conditions.
3. “Sign up” refers to the act of completing the service use contract by filling in the relevant information on the membership registration form provided by the association and agreeing to these terms and conditions.

Article 3 (Effect and Change of Terms and Conditions)

1. These terms and conditions become effective by disclosing them to the user.
2. The association may change these terms and conditions, and the changed terms will be announced separately on the association's home page. If the user does not agree to the terms and conditions, the user may cancel his or her membership registration, and if the user continues to use it, it is considered as consent to the change of the terms and conditions. The revised terms and conditions will take effect in the same way as in the preceding paragraph.
3. Matters not specified in these terms and conditions, if stipulated in the relevant laws and regulations, will be followed.

Chapter 2 service provision and use

The contract of use is established by the user's application for use and the consent of the association.

Article 5 (application for use)

The application for use is completed when the applicant agrees to these terms and conditions, submits the application form by filling in the registration information according to the form, and completes the payment of the annual fee, and the association accepts it.

Article 6 (approval of application for use)

1. When the user completes the application for use, the Association approves the application for use without delay after confirming the necessary matters.
2. The Association may withhold or disapprove the application for use of a specific user if it is necessary for user management and operation of the association's website, or if it is difficult to understand due to social conventions.
3. The association will approve the applicant's application for membership, except in the following cases.
a. If you want to use this service for illegal purposes
b. When applying for the purpose of hindering social well-being and order or morals
c. If it is reasonably judged that the conclusion of other use contracts violates relevant laws or these terms and conditions

Article 7 (service use)

1. The use of the service is in principle 24 hours a day, 365 days a year, unless there is a special problem with the association's business or technology.
2. The association may temporarily suspend the provision of services in the event of maintenance, inspection and replacement of devices such as systems, system breakdowns, loss of communication, or other force majeure reasons.
3. The Association does not compensate for damages incurred by users or third parties due to the reasons described in Paragraph 2.
4. The association may provide members with various information deemed necessary to use the service to members by e-mail or letter mail.

Chapter 3 obligations and responsibilities


Article 8 (Obligation of Association)

1. Unless there are special circumstances, the association allows users to use the service on the start date requested by the user.
2. The association is obligated to endeavor to provide the service continuously and stably as stipulated in these terms and conditions.

The association shall not disclose or distribute the user's personal information known in connection with the provision of the association's website to a third party without the consent of the user. However, this is not the case if there is a request from the relevant state agency in accordance with the provisions of related laws such as the Framework Act on Telecommunications.

Article 9 (User's Obligation)

1. The user shall pay the fees specified in these terms and conditions in exchange for the use of statistical data and association publications (hereinafter referred to as “information data”) services among the services of the association's website.
2. The user shall not reproduce the information obtained using the association's homepage for any purpose other than the user's use or provide it to a third party without prior consent of the association.
3. When a change in member information occurs, the user must immediately revise and register the change. Users are responsible for all consequences of not modifying member information.

Article 10 (use fee)

1. Among the services of the association's website, users of information materials must pay the usage fee set by the association.
2. The fees to be paid by users in connection with the use of information materials are as follows.
a. Usage fee: 100,000 won / year
b. Period of use: It is one year from the month when the service application and information usage fee are paid.

Chapter 4 Termination of Contract and Restriction of Service Use

1. When a user wishes to terminate the use contract, the user himself/herself must apply online by selecting “Request withdrawal” from the personal information management menu.
2. The Association may terminate the use contract without prior notice or suspend the use of the service for a fixed period if the user has committed any of the following.
a. If it is against public order and morals
b. In case of criminal activity
c. When a user plans or executes the use of the service for the purpose of hindering the national interest or social public interest
d. In case of stealing someone else's service ID and password
e. In case of damaging the honor or disadvantage of others
f. When the same user double-registers with a different ID
g. In case of impeding the sound use of the service, such as harming the service
h. In case of violating other related laws or conditions of use set by the association

Chapter 5 other matters


Article 12 (Disclaimer)

1. The Association is exempted from responsibility for providing web services if it is unable to provide web services due to natural disasters or equivalent force majeure.
2. The Association is not responsible for any disadvantages arising from the user's failure to violate the expected profits from the association's service provision or the selection or use of service data.
3. The association is not responsible for any obstacles in the use of the association's website due to reasons attributable to the user.
4. The association is not responsible for any profit or loss arising from the information obtained by the user using the association's website.
5. The Association shall not be held liable for product transactions between users or between users and third parties through services.

Article 13 (other matters)

1. Any accompanying documents, such as an asterisk or attached sheet attached to this agreement, are effective as part of the agreement.
2. Any matters not specified in these terms and conditions or matters that are objectionable to interpretation will be handled by agreement between the association and the user.
3. If a lawsuit is necessary for all disputes arising while using the association's website, the final settlement will be made in accordance with the arbitration award of the Korea Commercial Arbitration Board.

[Addendum]


(Effective date) These terms and conditions will be effective from April 20, 2021.

(Transitional Measures) Customers who have signed up according to the terms of use prior to the enforcement of these terms and conditions will be subject to these terms and conditions from the changed effective date.
